TERMS AND CONDITIONS:

Accounts:

By registering an account with Integrity Auctioneers, LLC (hereafter named “Company”) bidders and consignors (hereafter named users) are agreeing to the Company holding and using user information for purposes of conducting auctions, allowing users to place bids through the online portal, arrange for payment of items, or make payment and communicate via email, mail and/or phone about upcoming auctions or new features, services and promotions. Registered users hold the Company harmless for any liability in regard to injury, fire, theft, accidental damage, breakage, etc.

The Company reserves the right to ban, disable or delete any user accounts for any reason whatsoever including but not limited to: failure to pay, abandonment of items, or fraud.

Auction Type:

Live-simulcast online auctions will end the bidding for each item when the auctioneer says “sold” for that item. Timed online auctions may be a hard close (bidding ends at a specific time), or soft close (a bid placed in the final moments of the auction will extend bidding). The auction type such as live, online or a combination of bidding for each auction can be found in the auction description at the top of the bidding page. Any additional fees applicable to an item/auction, and loadout/pickup schedule will also be in the auction description.

Auction Process, Agents for the Seller, Online Bidding:

Everything is sold as is where is. There are no guarantees to condition by the Company. All guarantees to condition are between the seller and the buyer. All sales are final. Placing a bid in-person or through the online portal is a binding agreement such that if the bid wins the auction, bidders agree to purchase the item for the amount bid, plus any applicable premiums and commission. Statements made at the auction take precedence over printed and digital material.

The Company, employees, and associates act as agents for the seller. All auctions are with undisclosed reserves unless specifically otherwise specified. All bids are subject to seller confirmation unless specifically otherwise specified. Sellers reserve the right to lower reserves at any time. If the online portal shows “reserve not met,” winning bidders should still be prepared to purchase the item for the winning bid.

The Company is not responsible for any glitches in the internet system. The Company reserves the right to pause, disable, extend or restart the bidding of any or all lots on an auction.  In the event of a tie bid between live bidders and/or internet bidders the winner will be chosen at the discretion of the auctioneer. If an item has a reserve, a bid will be an absolute bid up to the reserve price.

Location & Inspection

Some items may not be at the auction location. Bidders are responsible for inspecting any item for condition. Bidders are encouraged to inquire about specific lot details such as condition and item location.

Payment, Fees, Shipping, Removal & Pick Up:

Payment is due immediately following the close of an auction unless otherwise stated in the auction description. Some auctions have a premium. See specific auction descriptions for buyers premium. Payment must be made in U.S. Dollars. Acceptable payments include cash, good check, money wire ($25 fee for international wire transfer), or major credit card (4% fee), unless otherwise stated in the auction description.

Each auction has specific pickup/removal times stated in the auction description. Buyers must pick up within these times or items will be considered abandoned. The Company offers shipping on select items/auctions. Buyers pay the Company any fees for shipping and handling if services/materials are used. Any special pick up times or shipping requests must be made prior to the auction.

Buyer Default, Fraud, & Abandonment:

Outstanding invoices will be considered defaulted after the payment deadline and credit card on file may be charged. Defaulted invoices and payment fraud may be subject to administrative fees legal fees and criminal charges and may result in the user being blocked from participating in any further auctions. Fake, shill bidding, or bidding on behalf of the seller for the purpose of manipulating the bid is unethical, against company values and prohibited.

Time limits to remove items are listed in the auction description. Buyers are responsible for coordinating pickup with the appropriate person. Buyers are responsible for all lifting, loading, and shipping equipment costs and labor unless otherwise stated. Pick up outside of specified times will incur charges of $100/hour including any necessary driving time for assistance.

The Company will determine the appropriate disposition approach for any defaulted or abandoned items which may include: selling/scrapping the item, and/or charging storage fees of $25/day after pickup times have expired.
